TERMS AND CONDITIONS: By submitting artwork for consideration for Plein Air Palm Beach presents Beyond the Studio: Paintings En Plein Air, the artist acknowledges and agrees to the following terms and conditions:
ELIGIBILITY AND ORIGINALITY: All submitted artwork must be the original work of the submitting artist and must have been created on location, from life, en plein air. Paintings and drawings created primarily from photographs are not eligible. Artwork created using artificial intelligence (AI), reproductions, giclées, or other mechanically or digitally reproduced works will not be accepted.
SELECTION OF ARTWORK: Submission does not guarantee acceptance into the exhibition. Artwork will be selected based on the exhibition criteria, available gallery space, and the exhibition's overall curatorial vision. Decisions of the curator and exhibition organizers are final.
PRESENTATION AND FRAMING REQUIREMENTS: All accepted artwork must be professionally presented and ready to hang at the time of delivery. Canvases must be either professionally framed or gallery wrapped. Gallery-wrapped canvases must have finished, painted, or otherwise professionally presented edges.
NOTE: Artwork must have two D-hooks securely mounted on the back of the frame, one on each side, approximately 2 inches from the top of the frame. Artwork must arrive with the required hardware already installed and ready for hanging. Artwork that is improperly framed, has inadequate or unsafe hanging hardware, differs substantially from the work submitted, or otherwise does not meet the exhibition requirements will be refused at delivery.
DELIVERY AND PICKUP: Artists are responsible for delivering accepted artwork on the designated delivery date and for picking up their artwork at the conclusion of the exhibition. Artists who cannot meet the scheduled delivery or pickup times must make arrangements in advance. Neither Plein Air Palm Beach nor New Studio for the Visual Arts is responsible for storing artwork not retrieved by the stated pickup deadline.
SALES AND COMMISSION: Artwork accepted for the exhibition must be available for sale at the retail price provided by the artist. Artists will receive 70% of the final sale price of their artwork. The remaining 30% will be retained as commission. By participating in the exhibition, artists authorize the exhibition organizers and/or the gallery to facilitate the sale of their artwork in accordance with these terms.
INSURANCE AND LIABILITY: Reasonable care will be taken in handling and displaying all artwork. However, artists exhibit their work at their own risk. To the fullest extent permitted by law, Plein Air Palm Beach, New Studio for the Visual Arts, the exhibition curator, and their respective officers, board members, employees, volunteers, representatives, and agents will not be responsible for loss, theft, damage, or destruction of artwork while in transit, during delivery or pickup, or while on exhibition, except as otherwise expressly agreed to in writing. Artists are encouraged to maintain their own insurance coverage for submitted and exhibited artwork.
PHOTOGRAPHY AND PUBLICITY: By submitting artwork, the artist grants Plein Air Palm Beach and New Studio for the Visual Arts permission to photograph and reproduce images of accepted artwork, as well as photographs taken during the exhibition and related events, for exhibition-related publicity, educational purposes, websites, social media, press releases, printed materials, documentation, and promotion of the exhibition and organizations. Copyright and ownership of the artwork remain with the artist.
INSTALLATION AND DISPLAY: The curator and exhibition organizers retain discretion regarding the placement, arrangement, installation, and display of accepted artwork. Artwork may not be removed from the exhibition before the designated closing date without prior approval.
CHANGES OR CANCELLATION: Plein Air Palm Beach and New Studio for the Visual Arts reserve the right to modify exhibition dates, schedules, requirements, or other details when circumstances require. In the event of circumstances beyond the reasonable control of the organizers, the exhibition may be postponed, modified, or canceled.
AGREEMENT TO TERMS: Submission of artwork constitutes the artist’s acknowledgment that they have read, understood, and agreed to these Terms and Conditions and all requirements stated in the Call to Artists. Failure to comply with these requirements may result in rejection or removal of artwork from the exhibition.
