A free one-day pop-up community arts festival in Waco Texas with an indoor juried artist exhibition, outdoor artist booths, food, and music. The event aims to celebrate the rich artistic culture in Waco, brought to you by Cultural Arts of Waco, founded and supported by NeighborWorks Waco.

There is a $50 fee for setting up a booth, and vendors will be approved based upon space availability and relevance to the event.

Booth size and end requests will be honored where possible. Each space is 10 ft by 10 ft. If you need more space, please request multiple booths and be prepared to pay $50 for each.

- All materials sold must be created by the person, group, or organization applying.
- Each approved vendor will be assigned a space and will be responsible for their own booth materials and setup. Tables and chairs will not be provided.

- A tent is suggested, as there will be limited shade and we are hoping for a sunny day! Merchants must abide by safety measures to ensure the booth/tent structure is adequately secure in case of bad weather or strong winds. Bring weights to secure tent; no stakes/ropes allowed.
- Merchants will not have access to electricity.
- No more than TWO (2) merchants or artists will be allowed per one booth space.
- Artist or representative must be present during the entire event.
- Artists are not allowed to sell merchandise away from assigned booth space.

Artwork/Merchandise can be in any fine art or fine craft medium and must be original.
- Prints for sale by artists in the digital or printmaking categories must be limited editions and properly signed and numbered.
- Reproductions of 2-D work must be clearly labeled Reproduction.
- Photographs must be original and signed by the artist.
The artist must own all the copyrights to all designs and images offered for sale.
- Ceramic works must be handmade by the artist. If multiple pieces of the same design are displayed, each must be signed.

- Art on Elm Avenue reserves the right to ask that work infringing the copyright of others is removed from the booth.
- Raffles, drawings, and/or solicited donations are prohibited.
- Artists may only sell the items or conduct activities that have been specifically approved in writing.
- All fees are nonrefundable if accepted.
- Please keep items family-appropriate.
Limited security will be present on the grounds; however, merchants are responsible for the security of their booths and contents. Art on Elm Avenue and organizers are not responsible for stolen or damaged property, or accident or injury. Merchants must comply with all staff and uniformed security regarding site safety regulations.

PARTICIPANT ACKNOWLEDGEMENT/RELEASE
I, participant, (hereinafter 'Booth Operator') hereby make an application to become a participant/merchant in Art on Elm Avenue. Booth Operator agrees to abide by the rules and regulations as set forth herein and such other rules as may be established or amended by Cultural Arts of Waco, Art on Elm Avenue, or the City of Waco. Booth Operator and assistants hereby release, forever discharges and holds harmless Cultural Arts of Waco, Art on Elm Avenue, NeighborWorks Waco, Event Officers, Sponsors, Volunteers, and the City of Waco, Texas from any responsibility or liability for loss, claims, damages, theft, injury or accident from activities conducted in preparation for, during and immediately following Art on Elm Avenue from May 27 through May 30, 2021. Booth Operator assumes full and complete responsibility and will hold harmless the City of Waco, its officers, council members, directors, servants, agents, employees or volunteers, Operator's agents, customers, or invitees. It is further agreed that Exhibiting Artist shall maintain his/her business practices in compliance with all applicable local, state, and federal laws and regulations. Booth Operator understands that violation of or noncompliance with this release or any rule, regulation, law, ordinance, or decree may result in immediate expulsion of Booth Operator and his/her exhibit from Art on Elm Avenue without a refund of any applicable fees paid. Booth Operator is responsible for all 'booth' set up and takedown of merchandise, displays, and tents or covers. It is further understood that each booth operator is responsible for assuring that all items in his/her own booth are well secured in the event of weather, i.e. wind, rain, etc., and that weights must be used to secure all corners and parts of the booth (tables, shelves, hanging racks, etc.) so as not to blow into or damage another booth operator's booth and merchandise. In the event that the booth Operator's tent or any part of the booth causes damage to another vendor's booth due to negligence on his/her part, the booth Operator will be responsible for those damages.
Cultural Arts of Waco, Art on Elm Avenue, and NeighborWorks Waco have my permission to reproduce submitted artwork for marketing purposes.
Cultural Arts of Waco, Art on Elm, the City of Waco, and Event Officers reserve the right to make the final interpretation of the rules.
