RULES/REGULATIONS
APPLICATION FEES AND REGULATIONS:
One application per medium category. Artists may apply in two categories if the work greatly differs in medium and technique. If an artist is accepted in more than one category, they must display both categories of work within a single booth.
ARTIST'S STATEMENT: A one-page artist's statement is required to apply. The statement must describe the technique, materials, and processes used in the creation of their body of work. .
IMAGES: Artists must submit at least three images of artwork, as well as a booth shot that shows a stocked and prepared festival booth.
ELIGIBLE WORK: All work exhibited must be original, designed and produced by the artist. Artists must only exhibit work in the media categories in which they are accepted. The work exhibited must match the quality, category and body of work submitted in the application. Please remember that the Danville Art Festival is a family-oriented event and works displayed must be in keeping with this atmosphere.
INELIGIBLE WORK: The following are prohibited: work created from kits, manufactured or kit jewelry, candles, soaps, food items, art supplies, ceramics cast from commercial molds, production artwork, work purchased from an outside source for resale, works reproduced or copied from works of masters, mass-produced note cards, inferior reproductions of original works on non-archival materials (laser prints or color photocopies), and work not in the category for which the artist was accepted.
REPRODUCTION POLICY: In order to provide art to a variety of budgets, the Danville Art Festival allows artists to sell high quality reproductions of their own two-dimensional art. Reproductions must be signed by the artist. Artists must market reproductions as such. Artists selling reproductions must also sell original works. Inferior or low-quality reproductions will not be accepted. Laser printed or color photocopies are not acceptable quality. 75% of the work must be original work. Reproductions must not exceed 25% of an artist's inventory. Artists exceeding 25% reproductions will be asked to reduce the reproductions to the proper ratio.
SALES TAX: Kentucky law requires collection of a 6% sales tax on all sales made during the Festival.
PUBLICITY: If selected to exhibit at the Danville Art Festival, I authorize use of the images submitted with my application or duplicates thereof for Festival publicity or documentation. I agree to grant a license to the Community Arts Center to reproduce electronically, in limited resolution, my original artwork for a period of up to thirty (30) months beginning January 1, 2019. I understand by submitting an application, I retain full copyright of my original artwork. My images shall not be redistributed except as anticipated on the website and in the Festival programs and other Festival related media, without my express written permission.
The Danville Art Festival is marketed through brochures, social media, digital advertising, state tourism, local newspapers, and the Great American Brass Band Festival.
BOOTH STAFFING: Artists must be present and must personally staff their exhibit space during the entire event. Each exhibiting artist must personally check in at registration and present photo identification.
Exhibitor agrees to open and close to the public at published festival hours. Any artist closing their booth prior to the end of the festival will not be permitted to return the following day or in subsequent years. Closing times are mandated by the City of Danville Festival permit and must be strictly enforced. Exhibitors who do not show up will not be re-invited.
SECURITY: Security will be provided on-site during the hours that the show is closed.
OTHER RULES: No animals are allowed on the Festival site. Smoking is prohibited within the event site.
BOOTH INFORMATION
Booth Fee: $125 must be paid by February 15, 2019. Booth fees are non-refundable.
Each space measures 12'x12'. The artist is responsible for providing his or her own tent (white 10'x10'), structures, tables and chairs. All booth materials, signage, and displays must fit inside the area.
Exhibitors should prepare for inclement weather by bringing appropriate rain covers, tie-downs, and weights. Adequate weights are REQUIRED. Artists may not tie ropes to benches, light posts, trees, neighboring tents, or anything else. You must use hanging weights. There is no staking within the festival footprint. Weights may be fashioned from PVC tubes or buckets filled with concrete or sand. Do not use plastic bags filled with sand as they may tear and create an unnecessary mess. Hang weights from each of the four upper corners using strong rope. Allow the weights to hang suspended off the ground (approximately 12' to 18') to keep your tent from twisting in the wind.
Booth assignments are at the sole discretion of the festival and are not interchangeable. The festival will attempt to honor specific location requests, but can make no guarantees.
All exhibitors must prominently display a copy of their one-page artist statement in their booths describing technique, materials, and processes used in the creation of their body of work.
The Danville Art Festival will provide no electricity. Generators are not permitted. Battery powered equipment: lighting, fans, etc. are allowed.
The Danville Art Festival reserves the right, if circumstances demand, to change the location of allocated space, slightly reduce or increase the size of space, or otherwise alter the shape of space allocated. The Festival also reserves the right to rearrange the layout of unoccupied areas, alter entrances and exits to and from the site, and to undertake other structural alterations as necessary.
SET UP/TEAR DOWN: Set up begins at 6:30 AM on 6/8/19. Set up ends by 11:00 AM and the Festival begins at Noon. Festival times are 12:00-7:00 PM on Saturday (6/8) and 11:00 AM-3:00 PM on Sunday (6/9.)
CHECK IN: Exhibitors must check in at the festival grounds with a photo ID prior to setting up.
LEGAL AGREEMENT:
Participant agrees to abide by the Rules and Regulation section of this prospectus. Additionally, Participant, being of legal age, desires to participate in the Danville Art Festival organized by the Community Arts Center.
Participant acknowledges that his/her participation or involvement as an exhibitor in the Danville Art Festival carries with it the potential for certain risks and liabilities. Being fully aware of the risks and inherent dangers in participating, Participant hereby elects voluntarily to participate and willingly enters into this release, waiver and indemnity agreement (the 'Agreement').
Without limitation for any injury, death, loss or damage caused to Participant and/or Participant's property, Participant agrees to assume all risks inherent in and dangers intrinsic to his/her participation, including but not limited to (1) the purposeful, reckless or negligent acts of any kind or nature by other participants or attendees; (2) the risks of failure or misuse of equipment or facilities; (3) certain hazards such as surface and subsurface conditions; and (4) weather, theft or vandalism. Participant understands that this list is illustrative, not exhaustive and acknowledges that he/she has been given notice of the risks inherent in and dangers intrinsic to his/her participation in the Danville Art Festival. Participant understands that failure to comply with guidelines and policies may result in expulsion from this year's festival and/or future festivals.
Participant expressly agrees to assume all risks and waives all rights to sue for any personal injury, death, loss or damage to personal property caused by such risks.
Therefore, in consideration of being permitted to participate in the Danville Art Festival, which Participant acknowledges is good and valuable consideration, Participant knowingly and expressly waives all rights to sue, and hereby agrees to indemnify and hold harmless the Community Arts Center, its members, managers, employees, agents, volunteers, successors, and assigns from any and all loss, claim, suit or judgment resulting from any personal injury, death, loss or damage to personal property claimed by or sustained to Participant or Participant's property claimed by or sustained to Participant or Participant's property; and further agrees to indemnify the Danville Art Festival or Community Arts Center, its members, managers, employees, agents, volunteers, successors, heirs and assigns from any and all costs of defending such claims, including attorneys' fees.
If Participant is a minor or otherwise under a legal disability, this Agreement shall be accepted by Participant's parent or legal guardian. By accepting, the parent or guardian agrees (1) to waive the parent's, guardian's, or Participant's right to sue; and (2) to assume, on behalf of the parent, guardian, and Participant, all obligations, duties and risks set forth in Agreement.
I have read this Release, Waiver & Indemnity Agreement. I understand that by accepting it, I give up certain rights I might otherwise have to recover damages for losses, death or injury. (A copy of this agreement will also be mailed to accepted exhibitors. At that time, the agreement must be signed and returned by mail or email to the show director no later than March 1, 2019.)
